Welcome to the web site of Bitescience (“we” or “us”), www.bitescience.com (the "Site" or "Web Site"). Bitescience is the sole owner of this Site. Set out below are terms and conditions for use of this Site and our Subscription Services. You agree to be bound by these terms if you use our Site or order any of our Subscription Services from our Site. Be sure to check this page periodically for updates, as your continued use of the Site signifies your acceptance of any changed items.
1. Subscription types and services
1.1 Bitescience provides two types of services: Individual Subscription Services (providing access through login name and password) and Institutional Subscription Services (providing access through IP link).
1.2 All subscription types give full access to the Bitescience Research Updates, Knowledge Database, and Bitefiles.
1.3 New subscriptions can start at any time during the year.
1.4 To subscribe to the Individual Subscription Services, you will be required to complete an application via our website. At that stage, you will be required to complete your contact and relevant personal details, make payment (if it is a paid-for service) and click your acceptance to these terms and conditions.
1.5 To subscribe to the Institutional Subscription Services, you are required to send an email to firstname.lastname@example.org, including your contact and institution details as well as the companies IP-range.
1.6 All subscriptions are subject to acceptance by us. We will send you an e-mail that confirms acceptance of your subscription application (the Subscription Confirmation).
1.7 Your subscription for paid-for Subscription Services will only commence once we have received full payment of all sums due for such Subscription Services.
2. Duration and cancellation policy
2.1 The trial subscription (individual subscription only) has a duration of one week and can only be subscribed to once by every user.
2.2 Paid-for individual subscriptions have a duration of either one month (monthly individual subscription) or one year (annual individual subscription).
2.3 Institutional subscriptions have a duration of one year.
2.4 Paid-for individual and institutional subscriptions will be automatically extended with the subscription term (one month or one year) unless prior notice is given beforehand by the subscriber.
2.5 Monthly subscriptions may be terminated by notifying us by email at email@example.com at least one week prior to the end of the subscription agreement period.
2.6 Annual subscriptions may be terminated by notifying us by email at firstname.lastname@example.org at least one month prior to the end of the subscription agreement period.
2.7 After the first subscription agreement period of one year, annual subscriptions may be terminated monthly by notifying us by email at email@example.com.
3.1 The one-week trial subscription is provided free of charge.
3.2 The price of a monthly individual subscription is USD 49 per month, excluding VAT and has to be paid upfront per month.
3.3 The price of an annual individual subscription is USD 499 per year, excluding VAT and has to be paid upfront per year.
3.4 The price of an annual institutional subscription is USD 699 per year, excluding VAT and has to be paid upfront per year.
3.5 Bitescience will be entitled to amend its prices once a year and will inform the customer if it intends to change its prices via the Bitescience website.
4.1 Our standard method of payment is PayPal. Please contact us for other types of payments. For more information about making payments through PayPal, please visit their web site at www.paypal.com.
4.2 A surcharge of USD 10 will be applied if you choose to receive a paper invoice.
4.3 Bitescience reserves the right to provisionally terminate the subscription contract in case of late payment.
4.4 You may cancel a paid-for Bitescience subscription contract within seven working days of the day after you receive the Subscription Confirmation. In this case, you will receive a full refund of the price paid for the Subscription Services.
5. Personal data
Bitescience is committed to protecting your privacy and the confidentiality of the information that you provide, retrieve and save. For more information see our Privacy Statement.
6. Access controls
6.1 Bitescience grants to each Authorized Subscriber a limited, nonexclusive, nontransferable, nonsublicensable, (subject to termination for breach of the license agreement) license to use Bitescience's subscriber site. The license agreement limits the number of users who are allowed access to the Site. You are required to take reasonable measures to protect access information and to assure that you do not permit unauthorized use of or access to the Site. Bitescience may audit your use of the Site to assure compliance with access restrictions and will pursue all available remedies for a breach of these access rules.
7. Our intellectual property
7.1 The Bitescience name (including the terms “Bitescience Knowledge Database” and “Bitescience Research Updates”) and logo are registered trademarks of Bitescience. All rights reserved.
7.2 The content, including the written materials, audio, video and all visuals on the Site is the intellectual property of Bitescience or is republished by Bitescience under limited exceptions to the copyright laws. All rights of Bitescience or other copyright holders are reserved. You may only download and use content from this site as permitted by this notice.
7.3 Bitescience grants permission to Member to use written content from Bitescience’s online service; provided, however, that the Company must always attribute the written content to Bitescience by maintaining all registration and service marks contained in such content. If you have obtained information from our Bitescience Research Updates, we prefer that you cite the original source as well as Bitescience. For example, you could cite "An & Stern (2011) in Journal of Advertising, as reported by Bitescience." We also encourage you to include the relevant uniform resource locator (URL) from our website, www.bitescience.com.
7.4 We encourage you to pass along any of our free content (newsletters and free articles) to others. However, information purchased individually or through a subscription package cannot be shared
8. Content of other sites
Our Site may provide links to web sites not operated by Bitescience. Access to any other sites linked to this Site is at your own risk. We assume no responsibility for third-party web sites. These other sites may send to users their own cookies, collect data, solicit personal information, or contain information that you may find inappropriate or offensive. We assume no responsibility for the content of or services offered by linked third party-sites, and make no representations concerning the accuracy of materials on third-party Web sites or their privacy policies. Statements made on third-party Web sites linked to or from this site reflect only the views of their authors and not of Bitescience.
9. Disclaimer and limitation of liability
9.1 Bitescience attempts to assure the accuracy and timeliness of all information provided on its site. However, the nature of the information reported is subject to change and different interpretations. Bitescience does not guarantee the accuracy of information found on the Site. Your reliance on information found on the Site is at your own risk.
9.2 The information in the Site is provided "as is" and without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. We do not warrant or make any representations regarding our observations, or the application to any use by you. We do not endorse any of the services or goods on any linked site, or any of the information contained in such third-party sites or content. We do not make any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) you might be requested to give any third party. We are not liable under any circumstances, including, but not limited to negligence, for any direct, indirect, incidental, special, or consequential damages that result from the use of, or the inability to use, the Bitescience site or content on the site, even if we have been advised of the possibility of such damages. If the applicable law does not allow the limitation or exclusion of liability or incidental or consequential damages, our total liability to you for all damages, losses, and causes of action (whether in contract, tort, including, but not limited to, negligence, or otherwise) may not exceed the amount paid by the party under the license agreement, if any, for accessing the Bitescience site.
10. Changes to this Agreement
10.2 Bitescience reserves the right to put the online activities on hold at any time. In this case, subscribers will receive a (partial) refund of the price paid for the Subscription Services.
11. Final provision
11.1 These terms and conditions enter into force on May 1st, 2013.
11.2 The law of the Netherlands shall apply to these Terms and Conditions.
